Computational models of relevance in case-based legal reasoning have traditionallybeen based on algorithms for comparing the facts and substantive legal issues of aprior case to those of a new case. In this paper we argue that robust models ofcase-based legal reasoning must also consider the broader social and jurisprudentialcontext in which legal precedents are decided. We analyze three aspects of legalcontext: the teleological relations that connect legal precedents to the socialvalues and policies they serve, the temporal relations between prior andsubsequent (...) cases in a legal domain, and the procedural posture of legal cases,which defines the scope of their precedential relevance. Using real examples drawnfrom appellate courts of New York and Massachusetts, we show with the courts' ownarguments that the doctrine of stare decisis (i.e., similar facts should lead to similar results) is subject to contextual constraints and influences. For each of the three aspects of legal context, we outline an expanded computational framework for case-based legal reasoning that encompasses the reasoning of the examples, and provides a foundation for generating a more robust set of legal arguments. This essay focuses on the phenomenon of synesthesia. In an attempt to differentiate between genuine synesthesia and metaphorical synesthesia, I have searched for shared traits among synesthetic visual artists, as well as among composers and performing musicians. The field of synesthesia has been rife with misunderstandings. Though ever increasing numbers of exhibitions, books, and articles have used the title or subtitle, “Synesthesia in art and/or music”, few of these adequately define synesthesia. The major cause of the problem is that art (...) and music historians and curators, as well as artists and composers themselves, have confused the desire to intermingle various art forms with the phenomenon of genuine synesthesia. I show the existence of recurrent patterns of artistic response to synesthetic experience, the evidence of shared characteristics, by taking the examples of Carol Steen, Marcia Smilack, Joan Mitchell, David Hockney, Messiaen. I also present the results of my investigation on the synesthetic perceptions of the pianist Joyce Yang. Cet essai porte sur le phénomène de la synesthésie. Pour bien différencier synesthésie authentique et synesthésie métaphorique, j’ai recherché des traits communs chez les artistes visuels synesthètes, ainsi que chez les compositeurs et les musiciens interprètes. Le champ de la synesthésie a été envahi par des malentendus. Bien que de plus en plus d’expositions, de livres et d’articles utilisent le titre ou le sous-titre « Synesthésie dans l’art et/ou la musique », peu d’entre eux définissent adéquatement la synesthésie. La principale cause du problème est que les historiens et les conservateurs d’art et de musique, ainsi que les artistes et les compositeurs eux-mêmes, ont confondu le désir d’entremêler diverses formes d’art avec le phénomène de la véritable synesthésie. A capoeira ou capoeiragem é uma expressão cultural brasileira que mistura jogo, esporte, arte marcial, cultura popular, tradição, dança e música. Desenvolvida no Brasil por descendentes de escravos africanos, a capoeira é caracterizada por golpes e movimentos ágeis e complexos, utilizando primariamente chutes e rasteiras, além de joelhadas e cabeçadas, cotoveladas, acrobacias aéreas ou em solo. Praticantes da capoeira aprendem não apenas a lutar e jogar, mas também a tocar os instrumentos típicos e cantar. Assim, os discentes do 6º ano (...) de uma escola estadual da cidade de Itabuna—BA, os quais apresentavam dificuldades para ler e escrever. Entretanto, nas aulas de capoeira, os alunos se mostravam mais motivados para ler. Então, surgiu o problema que norteou essa pesquisa, a saber: como o jogo de capoeira vem sendo trabalhado, para estimular a melhoria da aprendizagem em leitura dos alunos, do 6ºano, em um colégio estadual, na cidade de Itabuna – BA? Portanto, o objetivo geral desse artigo é analisar de que maneira o mestre usa o jogo da capoeira, como ferramenta motivacional, nas práticas pedagógicas, para a melhoria da aprendizagem da leitura, entre os alunos do 6º ano, do ensino fundamental II. Desse modo, a utilização de estratégias de leitura, partindo da diversidade dos gêneros textuais, de modo lúdico, através da capoeira, no processo de ensino-aprendizagem, é um assunto que é discutido nessa pesquisa, pois esta se justifica pela necessidade de contribuir para uma melhora do processo de ensino e aprendizagem, partindo de pressupostos presentes na BNCC. Cultural symbol systems (...) often have affective as well as objective referents, giving them a strong directive effect. The argument is made that in the process of repeated social transmission and use, cultural programs come to take forms which have a good “fit” to the natural capacities and constraints of the human information processing system. Bribery has previously been viewed as a two-party transaction between the bribe-offerer and the bribe-taker. But there is a third party: the one who has a prior claim on the bribe-taker's loyalty. Breaking the first contract in response to the offer of a bribe is alienation of agency (a category that strictly includes bribes): alienation of agency is the additional immorality of bribery beyond any immorality of the act solicited by the bribe.

The Machiavellian model is often praised as a realistic description of modern corporate life. My analysis of Tne Prince follows Rousseau in arguing that the prince can survive and prosper most easily by creating an environment in which almost all the citizens prosper. Far from licensing unrestrained self-aggrandizement, in this model success only comes from providing real value to almost every citizen for the entire period of one's leadership.Translation from the early sixteenth to the late twentieth century is far from (...) simple; for example, the CEO is in many ways far less powerful than a Medici prince. The closest approximation is a far less bureaucratic organization with very small units possessing maximum autonomy. Also, deciding who is, and who is not, a citizen is not nearly as straightforward as it was for Machiavelli; it probably includes every stakeholder on whom the corporation has a major impact. In Theory Z-style management everybody participates in corporate decision making. This more open process should give us fewer Pintos, Love Canals, and massive international payoffs as executives are forced to expose their reasoning to the moral sensibilities of the whole corporation. So far everything looks good. But we are a long way from showing that only corporations so managed can be fully moral. Yet Dwiggins seems to believe this, putting his faith in the basic goodness of the many while virtually (...) dismissing the managers as mere technicians. This is too slick; even if it describes our average corporation today, there are plenty of less radical changes which can also produce the desired moral corporation. Good leadership which acts on their commitment to improve the company is surely one historically respectable alternative; cynicism about the present crop of leaders should not distract us from investigating this route. Finally, I wonder if Dwiggins can consistently urge us to embrace a full-scale Theory Z organizational structure, given his position on the place of ethics and profitability. (shrink)

The prevailing opinion in our culture is that bribery is in principle wrong. I challenge that view and offer an analysis that suggests that bribery is a morally neutral concept. The analysis closely parallels the legal notions, suggesting that this analysis may have a firm grounding in our own tradition in spite of the prevailing views. To bribe someone is to offer something of value to another with the intent of inducing an action that is contrary to the positional duties (...) of the office or role of that other person. Whether offering or accepting a bribe is morally correct or incorrect, then, depends entirely upon whether the relevant positional duties have moral backing, all things considered. One virtue of the analysis is that it provides a definition that allows for a cross-cultural comparison that does not impose the standards of one society on those of another but allows for moral judgment. To determine whether a Japanese official has accepted a bribe, for example, one must determine the positional duties of the official as defined in that culture. The analysis also reveals why most believe bribery to be prima facie wrong. This is explained historically by the fact that the concept originally applied exclusively to positional duties in the judicial system, where all believed it to be morally unjustified to transgress duties of impartiality, etc. Finally, the analysis suggests that beliefs about the immorality of commercial bribery rest on the assumption that the positional duties of corporate managers and agents are to abide by the fictitious free-market rules and that the rules of the free market are morally justified. Representing species-specific proteins and protein complexes in ontologies that are both human and machine-readable facilitates the retrieval, analysis, and interpretation of genome-scale data sets. Although existing protin-centric informatics resources provide the biomedical research community with well-curated compendia of protein sequence and structure, these resources lack formal ontological representations of the relationships among the proteins themselves. The Protein Ontology (PRO) Consortium is filling this informatics resource gap by developing ontological representations and relationships among proteins and their variants and modified forms. Because (...) proteins are often functional only as members of stable protein complexes, the PRO Consortium, in collaboration with existing protein and pathway databases, has launched a new initiative to implement logical and consistent representation of protein complexes. We describe here how the PRO Consortium is meeting the challenge of representing species-specific protein complexes, how protein complex representation in PRO supports annotation of protein complexes and comparative biology, and how PRO is being integrated into existing community bioinformatics resources. Being hit or being given away are subabusive, common behaviors that harm companion animals. Violent childhood socialization increases the risk of adult abuse of animal companions, but relatively little is known about the origins of societally tolerated maltreatment of pets by adults. University students completed surveys about general attitudes toward animals, family socializaton, and current relationships with pets. These students generally had positive childhood socialization about pets and reported high levels of current attachment. Adults whose parents had given children's companion (...) animals away had a heightened likelihood of giving their own pets away. Mothers' kindness to their children's pets was associated with adults' attachment to animal companions, but attachment was not related to the likelihood of hitting current pets. People who score high on a measure of pet abuse potential hit their pets. The pattern of findings related to gender implies that males are at somewhat greater risk for having negative socialization experiences involving pets, for greater pet abuse potential as adults, and for weaker attachments. However, females were equally likely to hit their pets or give them away. The childhood predictors of attitudes about animals, pet abuse potential, hitting pets, giving away pets, and attachment found in this nonclinical, noncriminal sample contribute to our understanding of developmental influences upon relationships with companion animals. An empirically sensitive formulation of the norms of transformative criticism must recognize that even public and shared standards of evaluation can be implemented in ways that unintentionally perpetuate and reproduce forms of social bias that are epistemically detrimental. Helen Longino’s theory can explain and redress such social bias by treating peer evaluations as hypotheses based on data and by requiring a kind of perspectival diversity that bears, not on the content of the community’s knowledge claims, but on the beliefs and (...) norms of the culture of the knowledge community itself. To illustrate how socializing cognition can bias evaluations, we focus on peer-review practices, with some discussion of peer-review practices in philosophy. Data include responses to surveys by editors from general philosophy journals, as well as analyses of reviews and editorial decisions for the 2007 Cognitive Science Society Conference. (shrink)

This paper explores the changes in cognitive function which occur as someone "loses consciousness" under anesthesia. Seven volunteers attempted a categorization task and a within-list recognition test while inhaling air, 0.2% isoflurane, and 0.4% isoflurane. In general, performance on these tests declined as the dose of anesthetic was increased and returned to baseline after 10 min of breathing air. A measure of auditory evoked responding termed "coherent frequency" showed parallel changes. At 0.2% isoflurane, subjects could still identify and respond to (...) category exemplars but showed impaired short-term memory function. Electrical stimulation at 0.4% isoflurane, intended to mimic the arousing effects of surgery, had a small, beneficial effect on performance. A mean of 63% of category exemplars was identified at this stage, but recognition memory for those exemplars was at chance on recovery. There was no evidence for learning of words presented at 0.8% isoflurane. (shrink)

The emergence of the new coronavirus at the beginning of 2020, considered a public health emergency due to its high transmission rate and lack of specific treatment, led many countries to adhere to social isolation. Although necessary, social isolation causes important psychological changes, negatively affecting the health of the population, including the older population. The aim of this study is to propose a 4-week, home-based physical exercise protocol for older people in social isolation and evaluate whether will promote positive changes (...) in psychological variables such as anxiety, mood, depression, and stress, and in the variables sleep, quality of life, and physical capacities in the older adults. The sample will be selected in a probabilistic way from individuals aged 60 years or more from the city of Itajaí. Of these, half will perform a home-based resistance training protocol, with 3 weekly sessions, for 4 consecutive weeks. For group allocation, patients will be randomized with a computer-generated 1:1 allocation to the physical exercise group or control group. Outcomes will be depressive symptoms, sleep quality, quality of life, stress, mood states, anxiety, and functional capacity, evaluated at baseline, after 4 weeks, and after 15 days of follow-up. This study will offer a home-based exercise protocol for older adults, with load progression and remote monitoring, thus filling a gap in the provision of PE in this population. The results will be able to identify possible improvements not only in physical health, but also in quality of life and mental health.Clinical Trial Registration: The trial registration was carried out in the Brazil Clinical Trials Registry.. The HRAF databases, eHRAF World Cultures and eHRAF Archaeology, each containing large corpora of curated text subject-indexed at the paragraph-level by anthropologists, were designed to facilitate rapid retrieval of information. The texts describe social and cultural life in past and present societies around the world. As of the spring of 2018, eHRAF contains almost three million indexed “paragraph” units from over 8000 documents describing over 400 societies and archaeological traditions. This chapter first discusses concrete problems of scale resulting from large (...) numbers of complex elements retrieved by any given search. Second, we discuss potential and partial solutions that resolve these problems to advance research, whether based on specific hypotheses, classification or identifying and evaluating embedded patterns of relationships. Third, we discuss new kinds of research possibilities that can be further advanced, have not yet been successfully attempted, or have not even been considered using anthropological data because of scale and complexity of achieving a result. Although we embrace creativity in literary endeavors, we would prefer that the foundation of our legal (...) system be something more substantial. Unfortunately, where US. criminal HIV exposure statutes are concerned, there appears to be little if any concrete connection between proscribed behaviors and what we know about HIV transmission risk. Twenty-four states in the U.S. make it a criminal offense for a person who has HIV to expose another to the virus through consensual sexual activities.
